IMS Engineered Products sued for age discrimination

A former employee is suing over claims of age discrimination.

Humberto Olivarez filed a lawsuit on Nov. 20 in the Circuit Court of Cook County against IMS Engineered Products Inc., citing unlawful age discrimination.

According to the suit, Olivarez was employed with the defendant from Feb. 27, 1989 until he was fired on May 3, 2012.

Olivarez claims he had consistently received positive performance evaluations from the defendant over the course of his employment, but after 22 years of employment, was advised he was being immediately transferred to an evening shift.

The complaint states that four months after the plaintiff was transferred to the evening shift, he received criticism and in May 2012, the defendant began requiring employees to complete quality inspection reports.

On May 3, 2012, Olivarez was terminated failing to prepare a quality inspection report, but asserts in his suit that similarly situated younger employees were not terminated for failing to prepare the reports.

Olivarez is seeking to enjoin the defendant from committing other acts of age discrimination,and wants lost wages, lost benefits, reinstatement, compensatory damages and costs.

He is being represented in the case by Richard J. Gonzalez of the Law Offices of Chicago-Kent College of Law.
