A home health care provider is facing suit over claims it committed medical malpractice and violated the Nursing Home Care Act.
Joe Dawkins III, as special administrator of the Estate of Joe Dawkins Jr., deceased, filed a lawsuit Nov. 25 in the Cook County Circuit Court against LMR Home Health Care Inc., Home Physicians PC, Home Physicians Management LLC, Home Physicians 2011 PC and House Physicians LLC, citing wrongful death and survival statutes and violations of the Nursing Home Care Act.
The complaint states Joe Dawkins Jr. was receiving home healthcare from the defendants. On Nov. 19, 2011, Dawkins went to The University of Chicago Medical Center emergency room with sepsis, uncontrolled diabetes, infection of the right lower extremity and multiple decubitus ulcers, according to the complaint.
The plaintiff contends Dawkins was admitted to the ICU, underwent an amputation and died on Nov. 25, 2011. The defendants failed to care for and monitor Dawkins, failed to respond to his physical condition and committed multiple violations of the Nursing Home Care Act, according to the complaint.
The plaintiff is seeking more than $50,000 in damages and is being represented in the case by Craig M. Sandberg of Muslin & Sandberg.
