The Bean Caffe sued after wrongly serving a peanut butter smoothie

A man is suing over claims he was wrongly served a peanut butter smoothie and had an allergic reaction.

Josue Angel Ortiz filed a lawsuit Nov. 2 in the Cook County Circuit Court against The Bean Caffe Co. Inc., citing negligence.

The complaint states on July 22, Ortiz ordered a chocolate smoothie from the defendant, but was instead served a peanut butter smoothie. He claims he had an allergic reaction to the peanut butter as a result of the  defendant's negligence.

Ortiz is seeking damages in excess of jurisdictional minimums. He is being represented in the case by Anthony R. Rutkowski of Rutkowski Law Group in Chicago.
