Rosenthal Manufacturing Co. sued for strict liablity

A man is suing after his arm allegedly got caught in a machine.

David Zacarias filed a lawsuit Dec. 6 in Cook County Circuit Court against Rosenthal Manufacturing Co. Inc., citing strict liability and negligence.

According to the complaint, the defendant was engaged in designing, manufacturing and selling a product known as the Rosenthal Sheeter Stacker.

Zacaria says on Dec. 7, 2011, he was using the Sheeter Stacker at his job when it malfunctioned, causing his arm to be drawn into the machine, resulting in severe injuries.

The complaint alleges that Rosenthal Manufacturing failed to ensure the product was not unreasonably dangerous and that when it left their control, it had manufacturing defects that made it dangerous, among other claims.

Zacarias is seeking damages in excess of the jurisdictional limit. He is being represented in the case by attorney John M. Power of Cogan & Power P.C.
