A company is suing its previous attorneys for legal malpractice.
Advance Iron Works Inc. filed a lawsuit Dec. 10 in the Cook County Circuit Court against The Law Offices of James X. Bormes P.C., James X. Bormes and Harvey Chase Jewett, citing legal malpractice.
According to the complaint, Advance Iron Works hired the defendants to represent them as a plaintiff in the case Advance Iron Works Inc. et. al. v. Simpson Construction Company et. al. in the Circuit Court of Cook County.
It alleges that during their representation, the defendants were negligent when they failed to timely and properly disclose an expert witness to testify on the company's behalf when it was necessary to disclose an expert to refute claims made by the defendants.
The company also alleges the defendants failed to inform it that it was barred from producing an expert when it was clear that not disclosing an expert would be detrimental to its case and withdrawing from representation less than a month before trial.
As a result of the defendants' alleged negligence, the plaintiff claims it was unable to collect anything in its claim against Simpson Construction and a judgement was entered against it in the amount of $112,734.83.
Advance Iron Works is seeking damages in excess of $50,000 and is being represented in the case by attorney Corey A. Benjamin of Benjamin and Shapiro Ltd.
