Surgical patient doesn't know who to blame for malpractice, sues multiple defendants

Jennifer and Michael Rubino are suing Dr. Benson Young, Presence Our Lady Of the Resurrection Medical Center and Northwestern Neurosurgical Associates S.C. following an allegedly botched surgery.

According to the complaint filed Oct. 24 in the Cook County Circuit Court, Jennifer was admitted to Presence on Oct. 25, 2011 to undergo a planned surgery performed by Yang to insert an intrathecal catheter and pain pump.

Following her surgery, Jennifer claims she went back to Presence in November 2011 because she was still experiencing pain and had cerebral spinal fluid leakage. She asserts she ad to undergo two more remedial surgeries at the hands of the defendants, and during one of the surgeries, her intrathecal catheter was cut.

Jennifer does not know which defendant actually cut her catheter so she is suing under a res ipsa loquitur theory. The Rubinos are seeking more than $50,000 in damages and are being represented by Chicago attorney Keith A. Hebeisen.
