A mother is suing doctors over claims her child was born with brain damage.
Tyneisha Ferguson, individually and as guardian ad litem for Ziylah Smith, the minor plaintiff, filed a lawsuit Dec. 6 in the Cook County Circuit Court against University of Illinois Medical Center andUniversity of Illinois Hospital & Health Science System.
The suit, which also names 100 potential John Doe defendants, alleges medical malpractice, negligent infliction of emotional distress and the family expense act.
According to the complaint, Ferguson received prenatal care for her pregnancy at University of Illinois Medical Center. On Dec. 8, 2011, Ferguson claims she was admitted for labor and delivery and on Dec. 9, 2011, Ziylah Smith was born.
Following delivery, the suit states Smith was diagnosed with Hypoxic Ischemic Encephalopathy, brain damage and other neurological injuries. Ferguson alleges the defendants were negligent by failing to properly manage her high risk pregnancy and expedite the delivery to prevent the injuries.
The plaintiffs are seeking a judgment in excess of $50,000 and are being represented in the case by attorney Haytham Faraj.
