City of Chicago cites eminent domain for intersection adjustments

The city of Chicago looks to eminent domain to acquire land necessary to reconfigure intersection.

The city of Chicago filed a complaint Jan. 3 in the Cook County Circuit Court against Exoho Associates Limited Partnership, Hinsdale Bank and Trust Company, Riverbend LLC, Mangrum Glass and Mirror, Yogurt Factory LLC, Outdoor Space, Plote Construction, Bijora Inc., Douglas Ventures LLC, Vision Quest Coaching, Chicago, Whirly Inc., My Gym, Bauer F&S Management, Cosmo's Designer Direct and unknown owners.

According to the complaint, on May 8, Ordinance S02013-2561, known as "Acquisition Ordinance," was adopted, authorizing the city to acquire parcels of land necessary to reconfigure the six-way intersection at Damen Avenue, Elston Avenue and Fullerton Avenue to improve safety and traffic flow.

The plaintiff says efforts have been made to come to an agreement with the owners on an acquisition price for the property, but failure to agree has led to the institution of eminent domain proceedings. According to the complaint, the property in question is 1880 W. Fullerton Ave.

The city is being represented in the case by attorney Rick Taylor of Mathewson, Wishnoff & Taylor P.C.
