Lutheran Home for the Aged sued for violating the Nursing Home Care Act

A nursing home is facing suit over claims it violated the Nursing Home Care Act.

Linda Plontke, as special administrator of the Estate of Lorraine Schoenbeck, filed a lawsuit Dec. 12 in the Cook County Circuit Court against Lutheran Home for the Aged Inc., Dr. Theodore Homa and Northwest Suburban Physicians LLC, citing negligence and the state's Nursing Home Care and wrongful death acts.

According to the complaint, Schoenbeck was a resident at Lutheran Home for the Aged from Dec. 2, 2011 until Dec. 13, 2011. Plontke claims the defendant failed to measure Schoenbeck's anticoagulation status and that she developed a hematoma.

Plontke contends that the hematoma became infected and on Jan. 7, 2012, hematoma died as a result of the sepsis caused by the infected hematoma.

The plaintiff is seeking more than $50,000 in damages and is being represented in the case by Michael T. Mertz of Hurley McKenna & Mertz.
