Steele and Loeber Lumber Company sued after man falls from cross-tie

A construction worker and his wife are suing over claims the cross-tie the man fell from was defective.

Andrew Cichon and Susan Cichon filed a lawsuit Dec. 11 in the Cook County Circuit Court against Steele and Loeber Lumber Co., citing negligence, strict product liability, breach of implied warranty and loss of consortium.

According to the complaint, Steele and Loeber retained Andrew Cichon on July 23 to construct a residential garage at 11618 S. Throop St. in Chicago. The Cichons contend the defendants provided all materials for the garage and Andrew constructed it according to the defendant's design and specifications.

The suit states that while Andrew was in the process of building the garage, he was standing on a lumber cross-tie designed, manufactured, sold and delivered by the defendant for use in the construction of the garage when it broke, causing him to fall and sustain injury.

The Cichons claim the cross-tie furnished by the defendant was in an unreasonably dangerous and defective condition and the defendant acted negligently.

They are seeking more than $50,000 in damages, plus costs, and are being represented in the case by Norman J. Barry Jr. of Donohue Brown Mathewson & Smyth LLC.
