Nancy Gidwitz is suing her former lawyer at Ungaretti & Harris LLP, accusing him of legal malpractice.
Filed Dec. 6 in the Cook County Circuit Court, the complaint accuses Gidwitz's former lawyer, J. Timothy Ramsey, of failing to preserve evidence in an unrelated and ongoing lawsuit he was representing Gidwitz in.
According to the suit, Ramsey became Gidwitz's attorney in 2006 and advised her on various matters concerning the construction of a home she was building in Chicago.
Gidwitz claims it became apparent shortly after construction began that it did not conform with the design. For instance, the plaintiff asserts the HVAC and ductwork systems were insufficient to properly control the temperature in the home.
The suit states that Ramsey attempted to get the builder to cure the design defects, but the builder refused, spurring Ramsey to advise Gidwitz to file suit.
Gidwitz is seeking an undisclosed amount in damages and is being represented by the Law Offices of David J. Fischer P.C.
