Mario Berrios filed suit Nov. 21 in the Cook County Circuit Court against Midway Neurological and Rehabilitation Center LLC.
According to his complaint, Berrios was admitted to Midway for long-term nursing care and rehabilitation in January 2013.
Berrios claims Midway knew he suffered from diabetes that limited his mobility, but failed to properly monitor his diabetes, which led him to develop ketoacidosis. He also alleges he developed decubitus ulcers after Midway failed to properly adopt a comprehensive skin care plan for him.
Berrios is suing for negligence under Illinois' Nursing Home Care Act. He is seeking more than $50,000 in damages and is represented by Jerome Schachter and Associates Ltd.
