Chicago firm, attorneys accused of malpractice in asbestos litigation

A couple is suing a Chicago law firm and some of its attorneys over allegations they failed to adequately prosecute mesothelioma claims against two corporate defendants.

Vernon Nelson and John Q. Nelson, individually and as a special administrator of the Estate of Eva Nelson, filed suit Nov. 27 in the Cook County Circuit Court against Cascino Vaughan Law Offices Ltd., Michael P. Cascino, Allen D. Vaughan, Robert J. McCoy and John Nolan.

According to the complaint, the Nelsons retained the firm in September 2004 after Eva Nelson was diagnosed with mesothelioma and the firm then sued multiple corporations.

The Nelsons claim that while the firm recovered more than $850,000 on their behalf in the litigation, they failed to adequately pursue claims against two corporate defendants that escaped liability.

They accuse the firm and named attorneys of committing legal malpractice by not thoroughly pursuing all of the claims against all of the viable defendants.

Cascino, Vaughan and McCoy are listed as attorneys at Cascino Vaughan Law Offices Ltd., according to the firm's website, which does not list Nolan.

The Nelsons are seeking more than $50,000 in damages and are represented by attorneys George W. Spellmire, Michael P. Simkus, Andrew P. Resor and Tim McInernery.
