Man sues nursing center over hip fracture

By Annie Cosby | Jan 30, 2014

A man is suing a nursing home, claiming its negligence led to a fall that left him with injuries.

Eddie Sims filed a lawsuit Oct. 17 in the Cook County Circuit Court against Cedar Pointe Rehab & Nursing Center LLC, doing business as Cedar Pointe Rehab & Nursing Center, and Premier Healthcare & Financial Services Inc., citing negligence, premises liability and the state's Nursing Home Care Act.

According to the complaint, Sims was a resident of the defendant's facility from Oct. 5, 2011 until Oct. 20, 2011, during which time he required assistance to perform his daily routine.

Sims claims he fell on Oct. 20 and fractured his left hip. He is accusing the defendants of being negligent in its care and failing to provide a safe environment and adequately prevent falls.

He is seeking damages in excess of the jurisdictional limits and is being represented in the case by attorney Jonathan W. Young.
