Pekin Insurance Co. seeks declaratory judgment in coverage dispute

An insurance company is seeking a declaratory judgment that is is not liable to provide coverage to a company.

Pekin Insurance Co. filed a lawsuit Jan. 9 in the Cook County Circuit Court against American Builders & Contractors Supply Co. Inc., Steven J. Matuszewski and Mary Ann Matuszewski.

The complaint states Pekin issued insurance policies to a contracting company called Carlson that was bought in 2009 by Bradco Supply Corp., which then merged into American Builders & Contractors Supply.

Pekin claims American Builders & Contractors Supply and Bradco are not entitled to coverage under an insurance policy it issued to Carlson. It is seeking a declaration from the court that it is not liable under the policy to defend American Builders & Contractors.

The insurance company is being represented in the case by Robert Marc Chemers of Pretzel & Stouffer.
