B&D Industrial Chemical Inc. sues to collect unpaid balance

A chemical company is suing over claims it never received payment after fulfilling orders.

B&D Industrial Chemical Inc. filed a lawsuit Jan. 3 in the Cook County Circuit Court against Oxy Dry Food Blends Inc., CPC Laboratories, Yasar Samarah and Bertha Alicia Campos, citing breach of contract, unjust enrichment, quantum meruit and breach of fiduciary duties.

According to the complaint, in August 2011, B&D began doing business with Oxy Dry Food Blends, which was then transferred to CPC Laboratories. While doing business with each other, the plaintiff claims there were multiple instances where it procured and delivered requested product for the defendants, who never paid.

B&D claims the defendants continue to refuse to pay the remaining balance of $95,371.07.

The plaintiff is seeking the unpaid balance in damages, plus interest and costs, and is being represented by Jason M. Metnick and Samuel J. Schumer of Meltzer, Purtill & Stelle LLC.
