Canadian Pacific Railway sued over employee injury

A railroad company is being sued over an employee's claim he was injured on the job.

Raymond Herbert filed a lawsuit Jan. 15 in the Cook County Circuit Court against Indiana Canadian Pacific Railway Co., citing violations of the Federal Employers' Liability Act.

The suit states Herbert was employed by the defendant and working in the Bensenville yard on July 21, 2012 when he was injured. Herbert alleges he twisted his knee while walking alongside the railroad tracks on loose rocks and uneven ground while working.

He claims the defendant failed to properly inspect and maintain its ballast and roadbed.

Herbert is seeking more than $50,000 in damages and is being represented in the case by Richard A. Haydu of Hoey & Farina.
