A doctor and his medical group are being sued for medical malpractice that a couple claims resulted in their newborn being born with brain trauma.
Jason Sullivan, as special administrator of the Estate of Padraig Sullivan, and Pam Sullivan filed a lawsuit Dec. 6 in the Cook County Circuit Court against Dr. Gil A. Weiss and The Association for Women's Health Care Ltd., citing the state's survival and wrongful death acts.
The complaint states between July 14, 2008 and Feb. 13, 2009, Pam was under the care of the defendants for pre-natal medical care. The Sullivans claim that in January 2009, Pam began expressing concern to the defendants of decreased fetal movement, but no non-stress tests were performed until Feb. 13, 2009.
The non-stress test showed no fetal movement and Pam delivered her child Padraig, via emergency c-section, according to the complaint that notes Padraig was born with severe brain trauma and injury.
The Sullivans state Padraig died on February 19, 2009 as a result of the trauma. They claim the defendants committed numerous negligent acts, including failing to appropriately investigate Pam's concerns of decreased movement.
The plaintiffs are seeking damages in excess of $50,000 and are being represented in the case by attorneys at Hilfman & Head P.C.
