Nursing home, employee sued over resident's fall

An assisted living facility is facing suit after a former resident fell.

Cheryl Renella, as independent representative of the Estate of Barbara A. Mosley, filed a lawsuit Oct. 18 in the Cook County Circuit Court against Sunrise Senior Living Management Inc., doing business as Sunrise at Fountain Square, and Lesley R. Durkan, citing negligence and the state's survival act.

According to the complaint, Mosley was a resident at the defendant's facility and was listed as high-risk for falling, requiring supervision and assistance with daily activities.

On Oct. 23, 2011, Renella claims Mosley fell in the early morning hours, resulting in injury that required hospitalization. The complaint alleges the facility and Durkan, who had been assigned to Mosley's care, were negligent in their duties to provide adequate safety and assistance.

Renella is seeking damages in excess of $50,000, plus costs, and is being represented in the case by attorney Charles A. Hornewer.
