Nursing home resident sues facility over fall

A resident of a nursing home is suing the company that owns the facility after falling and injuring herself.

Phyllis Diomede filed a lawsuit Feb. 11 in the Cook County Circuit Court against Mid America Care Center LLC, doing business as Mid America Care Center, citing negligence.

The lawsuit states Diomede was a resident of the facility in March 2012 and that staff knew she was a high risk for falls. She claims she fell several times and sustained injuries, including fractures, contusions and lacerations.

Diomede is seeking damages in excess of $50,000, including court costs, and is being represented by Jason M. Kellerman of the Law Offices of Steven J. Malman.
