A woman is claiming her son was injured while under the care of another.
Patricia Hernandez, individually and as mother and next friend of a minor boy, filed a lawsuit Feb. 25 in the Cook County Circuit Court against Edward Garcia, citing negligence, premise liability and the Family Expense Act.
According to the complaint, Hernandez's son sustained injuries on Feb. 2, 2012 when he was tackled to the ground while under the care of Garcia and on his Cook County property.
Hernandez contends Garcia was negligent for improperly supervising and monitoring the minors in his care, failing to use proper and safe procedures to ensure the safety of minors and for failing to warn users of the potentially dangerous uneven condition of the yard.
She is seeking damages in excess of $30,000 and is being represented in the case by Scott A. Blumenshine of Law Offices of Meyer & Blumenshine.
