Progressive Northern Insurance sues to recoup damages paid out to insured in car crash

An insurance company is seeking repayment from a driver who alleged caused a collision with its insured.

Progressive Northern Insurance Co., as subrogee of Dr. Michel H. Malek, filed a lawsuit April 3 in the Cook County Circuit Court against David Mitchell.

The complaint states Progressive issued insurance to Malek that included a deductible collision clause. As required under the clause, Progressive was required to pay Malek $38,522.11 for damages sustained during the collision with Mitchell, the suit states.

The insurance company is now suing Mitchell to recoup the damages it had to pay out, claiming it was his negligence that caused the crash.
