Med-mal complaint accuses doctor, nurse of failing to diagnose post-surgery issues

A doctor and nurse are being sued over claims they failed to diagnose and treat a patient with post-surgery complications.

Phillip Depoister and Diane Depoister filed a lawsuit May 23 in the Cook County Circuit Court against Dr. Sergey Neckrysh and Allison Blood, citing medical malpractice and loss of companionship.

According to the complaint, Phillip went to the defendants on May 24, 2013 with complaints of balance issues and was diagnosed with a cyst, which Neckrysh operated on that same day.

After Phillip was discharged, Diane Depoister made several calls in which she spoke to Blood regarding complications Phillip was having, including lower body numbness and failure to have bowel movement, the suit states.

The Depoisters claim the defendants failed to promptly see Phillip when he first started complaining of numbness and failed to promptly diagnose and evacuate the compressive fluid on his spinal cord.

They are seeking damages in excess of $50,000 and are being representing in the case by attorney Louis Hilfman of Hilfman & Head P.C.
