Rivers Casino faces suit over alleged parking lot beating

A man is suing a Des Plaines casino and two men, claiming he was got beat up in the venue's parking garage.

John Stuermer filed a lawsuit June 11 in the Cook County Circuit Court against Midwest Gaming & Entertainment LLC, doing business as Rivers Casino, Aidas Gaigalas and Donatas Rakauskas, alleging negligence, premises liability and battery.

According to the suit, Stuermer went to Rivers Casino on Aug. 5, 2012. When he left through the casino’s north exit adjacent to the parking garage, Suermer claims Gaigalas and Rakauskas beat him, without provocation in the parking lot.

His suit includes battery counts against Gaigalas and Rakauskas, alleging they struck him, causing pain and suffering, disfigurement and medical expenses.

It also accuses the casino of failing to have adequate staffing to make the area safe, warn guests of previous crime incidents, keep the parking lot and outside areas safe, establish internal procedures to protect guests, install a security system on the exterior of the building, provide adequate training to employees regarding safety, require employees to monitor criminal activity, and document, investigate and monitor criminal activity.

Stuermer is seeking damages in excess of jurisdictional limits and is represented by Ryan T. McNulty of Schiff Gorman LLC in Chicago.
