A Delaware company is suing several attorneys who handled the foreclosure sale of its Chicago property.
2011-1 SFR Venture LLC filed suit June 10 in Cook County Circuit Court against the Chicago law firm of Jaros Tittle & O'Toole Ltd., and attorneys William G. O'Toole and James E. Trausch.
According to the complaint, the defendants represented SFR Venture in a foreclosure case beginning on Sept. 17, 2012. The company claims the defendants handled the paperwork regarding the foreclosure of the property and its sale for the amount of $178,701.
SFR Venture asserts the defendants have refused to pay it any of the sale proceeds as required by their original agreement. The company accuses the defendants of legal malpractice, breach of fiduciary and conversion.
The plaintiff is seeking a judgment of $178,701, plus punitive damages and costs. It is represented by Chicago attorneys Ralph T. Wutscher, F. John McGinnis and Jeffrey Karek of McGuinnes, Wutscher, Beiramee LLP.
