Potbelly Sandwich Works, bicycle deliveryman face suit over collision with pedestrian

A man is suing over claims he was hit by a cyclist working as a deliveryman for a sandwich chain.

Richard Pancoska filed a lawsuit June 16 in the Cook County Circuit Court against Potbelly Sandwich Works LLC and Dustin William Parker, alleging negligence.

According to the suit, Pancoska suffered injuries when a bicycle driven by Parker, a deliveryman for Potbelly, collided with him while he was walking westbound on South Prairie Avenue in Chicago on June 16, 2012.

The suit alleges Parker failed to lookout for pedestrians and failed to yield the right of way to Pancoska, resulting in the collision.

Pancoska is seeking damages in excess of $50,000, as well as court costs, and is being represented by Chicago attorney Frank J. Olavarria of Law Offices of Frank J. Olavarria P.C.
