Pedestrian hits driver with suit over collision in Swamp-O-Rama parking lot

A man is suing a driver he claims he hit while walking toward the Swamp-O-Rama flea market on Ashland Avenue.

Joel Alatorre Frausto filed a lawsuit in the Cook County Circuit Court on July 23 against Alturo Torres, alleging negligence.

According to the lawsuit, Frausto was walking in a parking lot toward the Swap-O-Rama store oat 4001 S. Ashland Ave. on March 24, 2013, when a vehicle driven by Torres struck him.

Frausto claims Torres failed to exercise due care, was speeding and failed to slow down, didn't keep a proper lookout and failed to keep his vehicle under proper control.

He is seeking damages in excess of $50,000 and is represented by the Shea Law Group of Chicago.
