A Cook County company is suing an electronic cigarette company it claims has failed to honor its return policy.
Eby-Brown Company LLC, filed a breach of contract lawsuit Aug. 19 in the Cook County Circuit Court against Vapor Corp.
According to the complaint, in 2010, Eby-Brown a convenience store distributor, entered into an agreement with Vapor Corp. for the purchase of electronic cigarettes.
In 2013, Eby-Brown claims Vapor Corp. refused to accept and refund products it brought and returned previously agreed upon. The plaintiff further accuses Vapor Corp. of failing to pay certain rebates and a fee for appearing at a promotional show, which along with the lack of refunds, totals more than $116,800.
Eby-Brown is seeking, after its own amounts owed to Vapor Corp. are applied, more than $92,500. It is being represented by David A. Eide of Karlin Eide LLP in Chicago.
