A man is suing the owner of a Niles fitness center, where he claims he was injured on the stairs of an overflowing whirlpool.
Nathir Yalda filed a lawsuit Sept. 2 in Cook County Circuit Court against Capital Fitness Inc., doing business as XSport Fitness, alleging premises liability.
According to the complaint, Yalda was a member of the Xsport gym on North Milwaukee Avenue in Niles on Sept. 4, 2012, when he approached the whirlpool and slipped on suds spilling out onto the stairs.
Yalda claims he sustained injuries, including a hip fracture, as a result of his fall, which he asserts was caused by the defendant's negligence in allowing the whirlpool to overflow.
Yalda is seeking more than $50,000 in damages and is represented by attorney Frank Olavarria of Frank J. Olavarria Law Offices in Chicago.
