Insurance company seeks $30K for pay out on water damage claim from condo association, others

A Cook County man and his insurance company are suing over claims the man's condo sustained property damage when it rained while his building was undergoing roof work.

Erie Insurance Exchange, as subrogee of Robert Guttman, and Robert Guttman filed a lawsuit Aug. 28 in Cook County Circuit Court against Block X Condominium Association, Legum & Norman Mid-West, and Berglund Construction Co.

According to the complaint, Block X Condominium Association and Legum & Norman Mid-West contracted Berglund Construction in December 2012 to perform roof work on their building on North May Street in Chicago, where Guttman lives.

The plaintiffs claim the defendants failed to cover the downspouts, and debris clogged one, causing rainwater to collect on the roof and enter the building, damaging Guttman's property on Dec. 20, 2012.

As Guttman's insurer, Erie Insurance paid Guttman more than $30,000 for his claim, and Guttman himself paid a $1,000 deductible.

They are both suing to recoup those payments and are represented by attorneys Thomas J. Costello III and Timothy P. Peterson of Best, Vanderlaan & Harrington in Naperville.

The case number is Cook County Circuit Court case 2014L008977.
