A man is suing a Cook County village over claims his brother was struck and killed by a police vehicle.
Oscar Morales, individually and as special administrator of the Estate of Fredi Morales, filed a wrongful death lawsuit Sept. 16 in Cook County Circuit Court against Village of Wheeling.
According to the complaint, Fredi Morales was crossing McHenry Road near its intersection with Cedar Run Drive at the entrance to the Sam's Club parking lot in Wheeling on Sept. 14, when he was struck and killed by a police vehicle that was allegedly traveling at a high rate of speed without its emergency lights or sirens.
The suit includes counts alleging wrongful death and intentional infliction of emotion distress, the latter of which deals with the family's experience arriving at the scene of Fredi Morales' death.
Oscar Morales is seeking more than $50,000 in damages and is represented by attorneys Erron H. Fisher and Michael LaMonica of Fisher & LaMonica in Chicago.
