A woman is suing over claims a relative died when she was fed by mouth in the hospital while on a feeding tube.
Maria Gutierrez, as special administrator of the Estate of Conchita Gutierrez, refiled a wrongful death lawsuit Sept. 30 in the Cook County Circuit Court against Dr. Mario Oliveros and Mario Oliveros M.D. S.C.
According to the complaint, Conchita was a patient at Kindred Chicago North Campus Hospital on West Montrose Avenue from Oct. 23, 2009 until Nov. 3, 2009, during which time she came under the care of Oliveros.
Gutierrez claims even though Conchita had a gastric feeding tube, she was fed by mouth, which caused food to lodge in her esophagus, leading to aspiration, suffocation and death.
Gutierrez is seeking more than $50,000 in damages and is being represented in the case by attorneys at Susan E. Loggans & Associates P.C. in Chicago.
