Rivers Casino patron claims intoxicated man attacked him

A man is suing the owner of Rivers Casino and a fellow customer who he claims was drunk and attacked him.

Krystian Misterka filed a lawsuit Oct. 1 in the Cook County Circuit Court against Midwest Gaming & Entertainment LLC and Daniel Podbielski.

According to the complaint, Misterka was at Rivers Casino in the Village of Des Plaines on Dec. 28, 2013, when Podbielski, an allegedly intoxicated customer, became violent and attacked him, punching, kicking and knocking him to the ground.

Misterka claims he was severely injured and required surgery. Midwest Gaming & Entertainment is being sued under the Dram Shop Act. Podbielski is accused of battery, and both defendants are accused of negligence.

Misterka is seeking more than $50,000 in damages and is being represented in the case by attorney Peter Zneimer of Zneimer & Zneimer P.C. in Chicago.
