Three people are suing over claims they were injured when the car in which they were passengers collided with a utility pole.
Kelsey Ibach, Bradley Schaum and Brittney Zingsheim filed suit Oct. 7 in Cook County Circuit Court against Philip Cho, Pure Sole Entertainment, 306 N. Halsted Inc., doing business as The Mid, and The Hubbard House Restaurant, doing business as Hubbard Inn.
According to the complaint, Ibach, Schaum, and Zingsheim were passengers in a vehicle driven by Cho, who was allegedly intoxicated at the time, and traveling eastbound on West Erie Street just west of North Halsted Street in Chicago on Sept. 13, when the vehicle left the roadway, struck a utility pole, and rolled.
The plaintiffs claim they sustained serious injuries. They accuse Cho of negligence, and Pure Soul Entertainment, a special events company, of vicarious negligence, because Cho was acting in the scope of his employment with the company at the time of the collision, the suit states.
The Mid and Hubbard Inn are sued under the Dram Shop Act for serving Cho alcohol Sept. 13, and allegedly causing his intoxication.
The plaintiffs are seeking more than $50,000 in damages and are represented by attorneys Edward W. McNabola and Terrance M. Nofsinger of McNabola Law Group in Chicago.
