A Cook County resident is suing a car manufacturer over claims her brand new jeep began showing transmission defects almost immediately after it was purchased.
Adrienne Isla filed a lawsuit Oct. 21 in Cook County Circuit Court against Chrysler Group, alleging breach of warranty.
According to the complaint, Isla purchased a $44,000 2014 Jeep Cherokee manufactured by the defendant at Sherman Dodge in Skokie on Oct. 26, 2013, and almost immediately experienced problems with the transmission, including delayed and harsh shifting.
Isla contends that Chrysler Group was required under the warranty to repair the vehicle through its network of authorized dealerships, but the jeep could not be fixed after multiple attempts. She alleges that an employee at one of Chrysler's authorized dealerships told her the manufacturer had known about this widespread problem with the transmission since it first started manufacturing the Cherokee.
According to the lawsuit, Isla attempted to use the defendant's informal dispute resolution process and, after waiting for a response for 60 days, no resolution was reached.
She accuses the defendant of breach of written warranty, breach of implied warranty under the Magnuson-Moss Warranty Act, and violating the Illinois New Vehicle Buyer Protection Act.
Isla is seeking damages in the diminution in value of the vehicle and costs of repair or a refund of the purchase price, as well as attorney fees. She is represented by Matthew Hurst of Heffner Hurst in Chicago.
