A Cook County company is suing its former lawyer over claims he failed to properly defend it in a foreclosure suit.
Midway Overhead Door Inc. filed a lawsuit Dec. 2 in Cook County Circuit Court against Chicago lawyer William Joseph Delaney of Delaney Law, alleging legal malpractice and breach of fiduciary duty.
According to the complaint, Delaney defended Midway during its foreclosure proceedings against Bank of America. Although he successfully negotiated a settlement with Bank of America, the suit alleges, Delaney failed to defend Midway when Bank of America relinquished its rights to the mortgage to INXS V, which went on to obtain a judgment against Midway for more than $1.1 million.
Midway seeks damages in excess of $50,000 plus court fees. It is represented by attorneys Ariel Weissberg, Rakesh Khanna and John B. Wolf of Weissberg and Associates of Chicago.
