The nightclub in Rivers Casino is being sued by a patron who claims she sustained injuries from a slippery dance floor.
Kelly Labellarte filed a lawsuit against on Dec. 4 in Cook County Circuit Court against Midwest Gaming and Entertainment, doing business as Rivers Casino Des Plaines and Cube Nightclub, Midwest Gaming Borrower LLC and Rush Street Gaming LLC.
According to the suit, Labellarte was at Cube Nightclub on Dec. 7. 2012, when she fell on the dance floor because it was slippery from multiple spilled drinks. She alleges the room was dark and smoke was blowing over it, making it difficult to see the floor.
Labellarte contends the defendants were responsible for ensuring the dance floor was safe, but failed to inspect and clean the floor, or provide the proper amount of lighting.
The plaintiff seeks more than $50,000 in damages and is represented by attorney Edward Proctor Jr. of Munday & Nathan in Chicago.
