Carson's customer claims clothing rack caused trip

A department store is facing a lawsuit from a customer who claims she tripped over a clothing rack that had been left unattended in an aisle of its Wilmette location.

Elsie Uribe filed suit in Cook County Circuit Court on Dec. 18 against McRil LLC and Bon-Ton Stores Inc., both individually and doing business as Carson Pirie Scott also known as Carson's.

According to the complaint, Uribe was in the Carson’s store in the Edens Plaza Shopping Center in Wilmette on July 26, 2013, when she tripped and fell over a four-wheeled clothing rack that had been left unattended in an aisle.

Uribe claims she received severe injuries, including bruising and lacerations, and incurred medical expenses as a result of the trip.

The suit alleges the defendants failed to practice proper precaution, maintenance or control over the store and knew or should have known that leaving the rack in the aisle would pose a hazard to customers.

Uribe seeks in excess of $30,000 for her injuries and  is represented by attorney Daniel R. Flaherty of the Law Office of Daniel E. Goodman LLC in Rosemont.
