A Cook County couple is suing a construction company over allegations a flood caused severe damage to their home and put their daughter in harm’s way.

Brian Anderson and Dallas Dyer filed suit Dec. 18 in Cook County Circuit Court against Walsh Construction Company II LLC, alleging negligence and infliction of emotional distress.

According to the complaint, Walsh Construction was engaged in work on the Bloomingdale Trail Project on June 30 and the byproducts from the construction blocked the storm drains in the plaintiffs' Chicago neighborhood.

When a heavy rain fell that night, the suit states, the neighborhood flooded, including the couple's home in the 1600 Bock of West Bloomingdale Avenue, causing severe damages and threatening the life of their daughter.

According to the complaint, a 4-foot wall of water broke through the plaintiffs' home, destroying certain parts of the house and causing structural damage to others. Dyer, the suit states, had to swim through the flood waters to save their daughter from her crib.

The plaintiffs are represented by attorney Alexander Loftus of Voelker Litigation Group in Chicago.
