Delivery of kosher-certified baking ingredients leads to lawsuit against transportation company

The rejection of a shipment of kosher-certified baking ingredients has led to a lawsuit between two transportation companies.

Skokie-based Command Transportation LLC filed the lawsuit Dec. 22 in Cook County Circuit Court against Ceva Ground US in Texas, alleging breach of contract.

According to the complaint, Ceva Ground was contracted by Command Transportation to deliver kosher-certified baking ingredients from Dallas to its customer, B.C. Williams Bakery Service Inc., in Industry, California on April 10, 2013.

Command Transportation claims that while Ceva Ground made the delivery, it did not follow specific instructions for the shipment as the load was to be sealed and locked before shipping to prevent any contamination during transit.

When the shipment arrived on April 12, the suit states the consignee checked the seal number and discovered Ceva Ground had negligently or willfully broke the original seal and replaced it with a new one.

Command Transportation contends that Ceva Ground is liable for the full amount of $51,203.36 that it paid to B.C. Williams Bakery, as well as attorney fees.

The company is represented by attorneys Melisande C. Loeppert and Neil B. Posner of Much Shelist in Chicago.
