The creators of an energy drink are facing a lawsuit that accuses them of failing to pay the $90,000 they promised to be a sponsor of the Arena Football League.
Arena Football One LLC (AF One), the operator of the indoor football league, filed a breach of contract complaint Tuesday in the Cook County Circuit Court against Miguel and Mary Jo Camarena.
The Camarenas are the co-founders of Aquarena Beverage LLC, an Arizona company behind Fuga Energy Drink, which is advertised as a healthy energy drink made of natural ingredients.
Under a written guaranty entered into on Oct. 31, AF One claims the defendants guaranteed they would pay it for a sponsorship for the 2014 and 2015 league seasons.
AF One asserts the couple, both of whom are believed to be Arizona residents, have failed to fulfill its obligation under the guaranty and as such, owe it $90,000.
According to a Mar 4 post on Fuga Energy Drink's website, the two-year partnership deal branded it as the "Official Energy Drink of the Arena Football League" and provided it a patch on all home jerseys.
In addition to the $90,000 it asserts is owed, AF One is seeking an award of attorney's fees and costs. It is being represented by Chicago attorney Wesley Friedman.
