Pleasantdale's school superintendent files petition to find out who to sue over blog comments

The retiring superintendent of Pleasantdale School District 107 wants to know made "disparaging and/or defamatory" remarks about him on a blog so he can figure out the appropriate party to sue.

Mark Fredisdorf filed a pre-suit petition for discovery on Feb. 24, asking the Cook County Circuit Court to order Gina Scaletta-Nelson, the school board's vice-president, to produce records to help him find out who is behind the comments on the "Everyone's Voice" blog.

If Scaletta-Nelson is the creator/maintainer of the blog as the petition suggests she is, Fredisdorf asserts she is in possession of the information he needs.

According to the petition, Fredisdorf entered into a retirement agreement with the board on May 14 that prohibited the board and its members from making any disparaging remarks about him.

He claims many disparaging and/or defamatory comments about him have been posted on the "Everyone's Voice" blog that dubs itself as a Pleasantdale community news blog. He thinks Scaletta-Nelson posted some of them anonymously in violation of the agreement.

Fredisdorf, who is set to retire from Burr Ridge and LaGrange school district following this school year, also alleges some of the comments and posts have been deleted.

The petition says Fredisdorf "believes that he has causes of action against [Scaletta-Nelson] and others but does not know who is responsible for the various posts."

"Discovery of blog ownership, posts/documents, other records/documents and possibly depositions are necessary" so Fredisdorf can determine "what causes of action he has and who is the appropriate party to sue."

Northbrook attorney Steven E. Glink filed the petition on Fredisdorf's behalf.
