Customer blames Durty Nellie’s for drunk patron stabbing him

A patron of a Palatine bar is suing over an alleged stabbing that took place last year.

Cody I. Caldwell filed a lawsuit March 6 in Cook County Circuit Court against D. Nellie’s Properties, also known as Durty Nellie’s, and the unknown individual who stabbed him.

According to the complaint, in the early morning hours of Nov. 27, 2014, Caldwell was stabbed by an unknown intoxicated patron. He claims he was a bystander and not involved in any ongoing altercations, but was stabbed in the hand with a sharp object, an injury that required surgery.

He alleges intentional battery on the part of the unknown assailant, and accuses the bar, under the state's Dram Shop Act, of failing to prevent the dispute(s) that led to his injury.

Caldwell seeks damages in excess of $50,000, plus attorney fees and costs, and is represented by attorney Christopher Ackeret of the Debt & Injury Law Center in Chicago.
