A woman is suing a man and his son over a hit-and-run car accident that she contends left her injured.
Maria Bautista filed suit March 16 in Cook County Circuit Court against David M. Diaz Sr. and David M. Diaz Jr.
According to the filing, Bautista was walking westbound at an intersection on 53rd Street in Chicago on May 15, 2013, when she was struck by a vehicle driven by one of the defendants.
The plaintiff, who was walking within a painted crosswalk when she was hit, alleges the defendant(s) fled the scene of the accident and that she and a witness were able to record the vehicle’s license plate number.
Bautista claims that while she was in the crosswalk, the defendant proceeded into the intersection while turning onto 53rd Street from Maplewood Street failed to keep a proper lookout, fled the scene of the accident and was otherwise negligent and careless.
She seeks damages in excess of $50,000, plus attorney fees and costs, and is represented by attorney Kevin Yen of Strom & Associates in Chicago.
