Mexican restaurant faces Dram Shop suit over pedestrian-vehicle accident

A man is suing a Rolling Meadows restaurant and one of its patrons over a car accident that left him injured.

Antonio Cazarez filed a lawsuit March 9 in Cook County Circuit Court against David Vidal-Soto and La Charanga Mexican Cuisine Inc., doing business as La Charanga Mexican Restaurant.

According to the complaint, Cazarez was walking east on Algonquin Road near the underpass of state Route 53 in Rolling Meadows on Jan. 18, when Vidal-Soto’s vehicle left the roadway and struck him.

The suit alleges several counts of careless vehicle operation, including: driving at a greater speed than is reasonable and proper; failure to brake, keep a proper lookout, and decrease speed in the presence of hazard; improperly leaving the roadway and driving on the shoulder; and fleeing the scene of the accident.

Cazarez accuses La Charanga of over-serving alcohol to Vidal-Soto under the state's Dram Shop Act, an act the suit alleges caused Vidal-Soto to become intoxicated and operate his motor vehicle erratically.

He seeks damages in excess of $50,000, plus attorney fees and costs, and is represented by attorney David Petrich of Sandman, Levy and Petrich in Chicago.
