O'Neil's on Wells patron alleges negligence in sidewalk fall

A restaurant patron has sued a Chicago business, alleging premises liability.

Edna Hardy filed a lawsuit March 20 in Cook County Circuit Court against O’Neil’s on Wells, O’Neil’s Bar & Grill Corporation, John Frega and Frega Associates, Bridgeview Bank & Trust Company as trustee and Dixon Enterprise, alleging in a 2013 injury.

According to the complaint, on March 22, 2013, Hardy was at O’Neil’s on Wells, at 411 S. Wells St., when she slipped and fell on the sidewalk. The defendant had sprayed water on the pavement, creating an unsafe condition and/or unnatural accumulation of snow and ice that caused the plaintiff to fall and sustain injuries, the suit states.

The complaint states that the surface condition was unapparent and the defendants were fully aware of the hazard it would create, and that the defendants collectively failed to remedy the condition, thereby increasing the possibility that other pedestrians and/or patrons would suffer physical harm.

Frega,  Frega Associates, Bridgeview and Dixon are cited in the suit in their capacity as building owner or managers.

The plaintiff alleges personal pecuniary and permanent damage.

Hardy seeks compensation in excess of $50,000, plus attorney fees and costs. She is represented by John Vrdolyak of The Vrdolyak Law Group of Chicago.
