Patron alleges negligence in McDonald's slip and fall

A customer has sued a local McDonald’s restaurant and four individual owners, alleging liability relating to a 2013 injury.

Sally Simon filed a lawsuit March 20 in Cook County Circuit Court against Speedy-Net Inc., McDonald’s Restaurants of Illinois Inc., McDonald’s Corporation; 315 Limited Partnership, Donald R. Conley Jr. and Suzanne L. Conley, alleging negligence liability.

According to the complaint, on April 20, 2013. Simon was at a McDonald’s in Wheeling, owned by Speedy-Net, 315 Limited Partnership, and Donald and and Suzanne Conley, when while getting up from a booth she slipped, lost her balance and fell while attempting to traverse a wet floor.

The suit states the defendants failed to properly maintain, inspect, mop and place warning signs on the damp surface, and cites several counts of negligence against the restaurant and its individual owners. The plaintiff alleges pain, suffering, mental anguish, disability, disfigurement, medical bills and out of pocket expenses.

Simon seeks damages in excess of $50,000, plus attorney fees and costs. She is represented by attorney Anthony Elman of The Elman Law Group in Chicago.
