CHICAGO – A railway conductor is suing his employer after a failed brake caused him to fall out of a rail car and severely injure his knee.
Louis F. Busch filed the lawsuit Feb. 3 in Cook County Circuit Court against Illinois Central Railway Co. and its associated subsidiaries.
According to the complaint, Busch was operating a rail car on July 29, 2012, when a brake failed and he tumbled out. The lawsuit alleges the railroad company’s negligence led to the brake failure.
Busch is seeking damages for his medical bills, disability, pain and suffering as well as attorney’s fees. He is represented by Craig W. Church of Hoey and Farina in Chicago.
