Company alleges local business failed to pay $295,000 for equipment rental

A company has alleged a customer to which it was renting equipment failed to make more than $295,000 in payments, breaching its contract.

Canon Solutions America Inc., successor by merger to Oce North America Inc., filed a lawsuit April 13 in Cook County Circuit Court against M2 Displays Inc., and its agents Bryan Mehr and Ashur Mooshiabad, alleging breach of obligation in a 2013 business agreement.

The plaintiff seeks to recover damages for breach of obligation under a written equipment rental from M2 Displays; and from each of the individual respondents for breach of personal guaranty.

According to the complaint, Canon’s predecessor company, Oce Financial Services Inc. (OFSI) leased reprographic and photocopying equipment and Oce North America Inc. (ONA) sold reprographic and photocopying equipment and supplies. M2 Displays provides the same services.

The suit says on Sept. 10, 2007, M2 entered a 62-month agreement with OFSI under which M2 rented equipment and contracted for maintenance services and supplies. M2 agreed to pay a fixed monthly amount. The suit says on Sept. 28, 2007, Mehr and Mooshiabad entered a contract of personal guaranty with OFSI.

ONA merged into Canon Solutions America Inc. (CSA) on Jan. 1, 2013.

According to the complaint, M2 breached the lease agreement by failing to pay for or return extra unneeded supplies.

Canon Solution seeks judgment for $295,254 for outstanding obligations under the agreement, plus $8,960 for the overdue supply bill plus interest, and attorney fees and costs. The plaintiff is represented by attorney P. Matthew Glavin of Glavin & Associates in Chicago.
