A family has sued a Cook County day care facility for liability in a 2014 incident.
An unidentified couple, the parents of an unidentified child, filed suit in Cook County Circuit Court April 28 against Children’s Land at Glenview Inc., of Wheeling, for alleged liability in an October 2014 injury.
The complaint alleges the infant was enrolled in the Children’s Land day care operation in Wheeling when the child sustained severe lesions and/or lacerations to her vagina while under the defendant’s care on Oct. 15, 2014.
The lawsuit states that the defendant was negligent in failing to take reasonable care when it handled the child so as not to cause injury; in hiring unqualified child care workers; in failing to provide adequately trained personnel who knew how to handle an infant, including changing a diaper; and neglecting to recognize and report the injury to her parents and medical personnel.
The parents seek damages of more than $50,000, plus attorneys’ fees and costs, citing res ipsa loquitor and violation of the Family Expense Act, and alleging their daughter sustained severe and permanent injuries, pain and suffering, medical bills, disfigurement and loss of a normal life. They are represented in the case by attorney Melanie Fairman, of Seidman Margulis and Fairman in Chicago.
